Professor Makau Mutua has issued a strong warning to the judiciary not to interfere with the impeachment process of Deputy President Rigathi Gachagua, describing it as fundamentally political.
On social media, Mutua recently expressed his disbelief that Kenyan courts would not exercise judicial restraint, claiming that they should stay out of cases that are merely political in nature. "Gachagua is dead politically," he stated bluntly. He cannot be brought back, not even by the Supreme Court. Let's move past this stupidity. The next Deputy President will be @KindikiKithure. These remarks offended some Kenyans who supported Gachagua, particularly since it was said that he was impeached while recovering in a Karen hospital bed. "I know many Kenyans haven't heard of the DOCTRINE OF JUDICIAL RESTRAINT," Mutua retorted to the charges levelled against him.

Mutua also emphasised that in addition to the general public, Gachagua has faced opposition from the legislative and executive branches of Parliament. This double rejection complicates Gachagua's efforts to get his job back. "Gachagua has been removed from office and completely rejected by the two POLITICAL branches, the legislature and the executive," he clarified.They have selected a replacement for him.
