Court Cites Why Rose & Her Son Were Held For 21 Days Despite 30 Days Application by Prosecution Team
Rose Mbithe Mulwa and her son Advocate Chris Mulwa were handed a major blow in their quest for freedom, after a Nairobi court ordered the duo to be detained for 21 more days, as detectives continue to probe the untimely murder of veteran clinical psychologist Dr. Victoria Nthunya Mutiso.
Although the prosecution team had filed an application to have the pair held for 30 days as they try to expedite their investigations, the court capped their stay in remand at three weeks, citing that there was sufficient reasons to hold them for long.
While giving the directive, the magistrate ruled out that release of the duo would have negatively impacted on the ongoing probe, citing that their release risked exposing key witnesses to unnecessary threats from the suspects, in a similar way the deceased had also allegedly received threats before her death.
In a sworn affidavit currently in court Corporal Romana Oduor who is leading the investigations over Dr Mutiso's murder had indicated that the deceased had received serious threats specifically on July 7, 2026, when she was stuck in traffic along Ngong Road when two men who were riding on a motorcycle ambushed her before one of the men pointed a firearm at her though she escaped unharmed.
In regards to the findings by the prosecution team that Dr Mutiso was threatened months before she was eliminated, the magistrate stressed out that it would not be assumed that the key witnesses in this case would be safe with the release of the pair
As a result, the magistrate ordered Rose Mbithe Mulwa to be returned for remand at Kileleshwa Police Station, while her son Advocate Chris Mulwa, be taken to custody at the Kilimani Police Station.
