Court Battle Looms After Lobby Groups File Petition Against Housing Bill


The Kenya Human Rights Commission (KHRC) and several lobby groups have filed a petition at the High Court challenging President William Ruto’s Affordable Housing Bill, igniting what could become a fierce legal battle over the controversial levy.

The petitioners argue that the deductions have placed a heavy burden on ordinary Kenyans, further shrinking already strained payslips. 

They claim the levy has worsened the cost of living crisis and pushed many citizens into poverty, while offering little transparency on how the funds are managed.

The groups also allege that the housing fund has been converted into a political tool. They cited recent remarks by President Ruto, who announced that 20 percent of the ongoing housing projects would be allocated to teachers and Harambee Stars players.

 According to the petitioners, such pronouncements point to favoritism and political patronage rather than fair distribution of resources.

KHRC maintains that while the government’s goal of providing affordable housing is noble, the current approach is unconstitutional and unjust. They are seeking court orders to suspend the deductions until the matter is heard and determined.

The case is likely to attract wide public attention, given that many workers across the country have openly expressed frustration over the levy.

 If successful, the petition could derail one of President Ruto’s signature programs and reshape the debate on how to balance development projects with the economic well-being of citizens.
